TERMS AND CONDITIONS FOR WINES OF THE WORLD

Welcome to Wines of the World (the "Website"), operated at www.winesoftheworld.ie. Please read these Terms and Conditions ("Terms") carefully before using our Website or purchasing any products or subscriptions from us.

By accessing our Website, creating an account, or placing an order, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use our Website or purchase our products.

1. LEGAL AGE REQUIREMENT (ALCOHOL SALES)

  • 18+ Restriction: It is illegal to sell alcohol to anyone under the age of 18 in the Republic of Ireland. By placing an order on this Website, you confirm and warrant that you are at least 18 years of age and legally permitted to purchase alcohol.

  • Age Verification: We reserve the right to use age verification checks at the point of sale. Furthermore, our delivery partners operate a strict "Challenge 25" or age-verification policy upon delivery. Valid photographic identification (e.g., Passport or Driver's Licence) matching the name on the order may be requested before goods are handed over.

  • Refusal of Service: If valid identification cannot be provided upon delivery, the delivery will be refused, the goods will be returned to our warehouse, and you may be charged a restocking fee.

2. GEOGRAPHICAL RESTRICTIONS

  • Republic of Ireland Only: This Website and our services are intended solely and exclusively for users residing in, and requesting delivery to, addresses within the Republic of Ireland.

  • Order Cancellation: We do not offer international shipping or cross-border delivery. If an order is accidentally or deliberately placed with a delivery address outside the Republic of Ireland, we reserve the right to cancel the transaction immediately and issue a full refund, minus any administrative or processing fees incurred.

3. ORDERS, PRICING, AND MINIMUM QUANTITY

  • Minimum Order Quantity: All orders placed on our Website are subject to a strict minimum order quantity of six (6) bottles of wine, spirits, or pre-mixed cases. Orders failing to meet this requirement cannot be processed through checkout.

  • Pricing & Taxes: All prices displayed on our Website are in Euros (€), include Irish Value Added Tax (VAT), and include relevant alcohol excise duties where applicable. Prices are subject to change without notice.

  • Contract Formation: Your order constitutes an offer to buy from us. A legally binding contract is only formed when we send you an email confirmation indicating that your order has been dispatched. We reserve the right to refuse or cancel any order for reasons including, but not limited to, stock unavailability, pricing errors, or suspected fraudulent activity.

4. DELIVERY TERMS

  • Delivery Areas: Delivery is available to valid physical addresses within the Republic of Ireland only. We do not deliver to P.O. Boxes.

  • Delivery Charges:

    • Standard delivery rates apply to orders under €75.

    • Free Delivery is provided for all orders with a total product value exceeding €75.

  • Delivery Attempts: If nobody over the age of 18 is present to accept the delivery at the designated address, the courier will leave a notification and attempt delivery at a later time. You may be held liable for additional shipping costs resulting from multiple failed delivery attempts.

5. MONTHLY WINE SUBSCRIPTION

  • Subscription Model: By signing up for our Monthly Wine Subscription, you agree to an ongoing recurring payment model where a curated mix of 6 different bottles will be delivered to your door month-to-month.

  • Billing Cycles: Your chosen payment method will be automatically charged on a recurring monthly basis on the anniversary date of your initial signup, or on a specific fixed billing date as stated at checkout.

  • Cancellation Policy: You can cancel your subscription at any time via your account portal or by contacting customer support at sales@winesoftheworld.ie. To avoid being billed for the subsequent month's selection, cancellations must be completed at least five (5) business days prior to your next scheduled billing date.

  • Refunds on Subscriptions: Once a subscription payment has been successfully processed and the month's box has entered fulfillment, that month's subscription cannot be refunded or canceled retroactively.

6. BREAKAGES, SHORTAGES, AND FAULTY GOODS

  • Transit Damage: Due to the fragile nature of glass bottles, breakages may occasionally occur during transit. You are required to inspect your delivery immediately upon receipt.

  • Reporting Window: Any breakages, missing bottles, or incorrect items must be reported to our customer service team within 48 hours of delivery by emailing sales@winesoftheworld.ie.

  • Evidence Required: You must provide clear photographic evidence of the damaged packaging and broken goods to qualify for a proportional refund or a replacement bottle. Do not dispose of the broken items or packaging until our customer service team has confirmed receipt of your report.

7. STATUTORY RIGHT OF WITHDRAWAL (RETURNS & REFUNDS)

  • 14-Day Cooling-Off Period: In accordance with EU Consumer Rights Regulations, you have the right to cancel your online purchase within 14 days of receiving your goods without giving a reason.

  • Exceptions: The right of withdrawal does not apply to items that have been unsealed, opened, or consumed, due to health protection and hygiene reasons.

  • Return Conditions: To exercise your right to return, all items must be returned to us unopened, unsealed, in their original packaging, and in a perfectly resalable condition.

  • Return Costs: You are responsible for paying the direct costs of returning the goods to our warehouse. Once the returned goods are received and inspected, a refund for the product value will be issued to your original payment method within 14 days.

8. INTELLECTUAL PROPERTY

  • All content, branding, logos, text, imagery, graphics, and product descriptions displayed on www.winesoftheworld.ie are the exclusive intellectual property of Wines of the World or its licensors. You are strictly prohibited from copying, reproducing, or commercially exploiting any material from this Website without our prior written consent.

9. LIMITATION OF LIABILITY

  • Wines of the World shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our Website, delayed deliveries caused by third-party couriers, or the consumption of our products. Our maximum liability to you for any order shall not exceed the total price paid by you for that specific order.

10. GOVERNING LAW AND JURISDICTION

  • These Terms and Conditions, and any disputes or claims arising out of or in connection with them, are governed strictly by the laws of the Republic of Ireland. Any legal actions or proceedings shall be subject to the exclusive jurisdiction of the Irish Courts.
